Asynchronous Online Training Courses

Preamble:

The training organization Le CFO Masqué has drawn up these internal rules to ensure the smooth running of its asynchronous online training courses. They aim to define the rights, duties and responsibilities of learners in the context of their participation in the training courses offered by the organization.

Article 1: Persons subject to the law

These rules apply to all learners of the CFO Masqué. Each learner is deemed to accept the terms of the present contract when following a training course provided by CFO Masqué.

Article 2: Purpose

The purpose of these rules is to establish the general rules applicable to learners enrolled in asynchronous online training provided by Le CFO Masqué.

Article 3: Access to the Training Platform

Learners must have Internet access to participate in online training.

Each learner will receive a personal login by e-mail to access the training platform.

Article 4 : Training sessions

Training courses are delivered in asynchronous mode, enabling learners to follow the courses at their own pace.

Training content will be available 24 hours a day, 7 days a week, for the duration of the course.

Exchanges between learners and trainers can take place via discussion forums or e-mail.

Article 5: Learners’ duties

Resources must be used exclusively for training purposes.

All exchanges and behavior between learners and trainers must be cordial and respectful.

Article 6: General health and safety rules

All trainees are responsible for their own personal safety and that of others, and for complying with the general and specific safety and hygiene regulations in force at the training site, depending on their training.

In accordance with article R.6352-1 of the French Labor Code, when training takes place in a company or establishment that already has internal regulations, the health and safety measures applicable to trainees are those set out in these regulations.

Students sent to a company for training are required to comply with the health and safety measures set out in the company’s internal regulations.

Article 7: Accidents

Any accident or incident occurring on the occasion of or during training must be reported immediately by the trainee involved, or those who witnessed the accident, to the organization’s manager.

In accordance with article R 6342-3 of the French Labor Code, any accident sustained by a trainee while in the training organization, or while travelling to or from it, must be reported by the training center manager to the social security fund.

Article 8: Assessment and validation

Periodic assessments will be organized to measure learners’ progress.

The course is validated by attendance, active participation and successful completion of assessments.

Article 9: Respect for copyright

Learners undertake to respect the copyright of the content made available to them and not to reproduce it without authorization.

Article 10: Penalties

Any failure by the trainee to comply with any of the provisions of these internal regulations may result in a penalty.

A sanction within the meaning of article R 6352-3 of the French Labor Code is any measure, other than verbal observations, taken by the training organization’s manager or his or her representative, following an action by the trainee which he or she considers to be at fault, whether or not this measure immediately affects the trainee’s presence on the course or jeopardizes the continuity of the training he or she is receiving.

Depending on the seriousness of the breach, the penalty may be as follows:

  • In other words, a warning;
  • Either a reprimand or a call to order;
  • Or permanent exclusion (please note that the organization’s agreement with the State or the Region sets out specific provisions for the application of the above sanctions).

Fines or other financial penalties are prohibited.

The person in charge of the training organization must inform the organization of the sanction taken:

  • The employer, when the trainee is an employee benefiting from a training course as part of the company’s training plan;
  • The employer and the joint body that has paid the training expenses, when the trainee is an employee on training leave.

Article 11: Disciplinary procedure

The following provisions are taken from articles R 6352-4 to R 6352-8 of the French Labor Code.

No penalty may be imposed on a trainee without first informing him or her of the charges against him or her.

When the head of the training organization or his or her representative is considering taking a sanction that has an impact, immediate or otherwise, on a trainee’s attendance at a training course, the procedure is as follows:

  • The head of the training organization or his representative will summon the trainee, indicating the purpose of the summons.
  • This specifies the date, time and place of the interview. It is in writing and is sent by registered letter or handed to the person concerned against receipt.
  • During the interview, trainees may be assisted by a person of their choice, either a trainee or an employee of the training organization.
  • The summons referred to in the previous paragraph shall mention this option. The head of the training organization or his or her representative will state the reason for the proposed sanction and will hear the trainee’s explanations. In cases where permanent exclusion from the course is envisaged, and where a training council exists, this is constituted as a disciplinary committee, with trainee representatives sitting on it.
  • After the above-mentioned interview, the head of the training organization or his or her representative refers the matter to the committee, which issues an opinion on the proposed exclusion measure.
  • The trainee is notified of this referral. At his request, he is heard by the Disciplinary Committee. In this case, he may be assisted by a person of his choice, whether a trainee or an employee of the organization. The Disciplinary Committee transmits its opinion to the organization’s Director within one clear day of its meeting.
  • Penalties may not be imposed less than one clear day or more than fifteen days after the interview or, where applicable, after the Disciplinary Committee has issued its opinion. The trainee is notified of the decision in writing, stating the reasons, by means of a letter delivered against receipt or by registered mail.

In the event of immediate disciplinary action (exclusion, suspension), no final disciplinary action may be taken without the trainee having first been informed of the grievances against him/her and, where applicable, having followed the procedure described above.

Article 12: Changes to the Regulations

The CFO Masqué reserves the right to modify the present rules. Learners will be informed by any means deemed appropriate.

Article 13: Disputes

In the event of a dispute, the parties agree to seek an amicable settlement. Failing this, the matter will be referred to the competent courts.

Article 14: Coming into force

These rules come into force on the date indicated at the top of the page.
